You are permitted to work in Australia while holding a Partner Visa subclass 309. This visa allows you to temporarily live and work in Australia with your partner while processing your subclass 100 visa application.

The Subclass 309 Partner (Provisional) visa allows for including dependent children in the application. However, the children must fit the category of dependent children as defined by Australian immigration.

The Australian government recognises same-sex couples and is eligible to apply for partner visas. To apply for a Partner Visa 309, same-sex couples’ eligibility conditions and application process are the same as opposite-sex couples.

The Partner Visa (subclass 309) permits you to stay in Australia for a period of up to two years from the date of the visa grant. During this time, you can live, work and study in Australia while you wait for the permanent Partner Visa (subclass 100). If you are given a Category 100 visa, you can live permanently in Australia as long as you follow the visa conditions.

The processing time for a permanent 100 visa begins two years after holding a 309 visa. It can vary depending on individual circumstances and the volume of applications being processed. You must hold a valid subclass 309 visa at the time of application for the subclass 100 visa. According to the DHA, the overall visa processing period may range from 6 to 32 months.
