How the Australian Employer Sponsorship Visa Works

The Australian Employer Sponsorship Visa program enables skilled foreign workers to live and work in Australia under the sponsorship of an approved employer. The process involves three main steps: employer sponsorship, nomination of a position, and visa application. First, the employer must be approved as a sponsor by the Australian government, demonstrating compliance with local labour laws and the ability to pay market rates for the role. Then, they can nominate a specific position that an Australian worker cannot fill.  

Finally, the nominated worker applies for the visa, demonstrating their skills, qualifications, and work experience that align with a position on the Skilled Occupation List and meeting health and character requirements. Successful applicants can secure temporary or permanent residency based on their visa subclass, such as the Temporary Skill Shortage (subclass 482) or Employer Nomination Scheme (subclass 186). Employer Sponsorship Visa Checklist

Navigating the Employer Sponsorship Visa application process involves gathering a range of crucial documents to ensure a smooth application submission. Here’s the essential checklist to guide you.

  • Nomination application form: Details the position being offered, ensuring it meets the visa requirements and demonstrates that the employer has met the necessary conditions to hire an overseas worker. 
  • 1442i:Outlines what further documentation or details are required for processing. 
Personal Documents
  • Passport 
  • Birth Certificate 
  • Drivers licence 
  • National ID cards (if applicable) 
  • Change of name documents (if applicable) 
  • Age exemption documents (45 years or older) 
  • Skills and qualifications documents 
  • English language documents 
  • Partner documents (marriage certificate or document to prove de facto relationship) 
Health and Characters
  • You must undergo a medical examination carried out by an accredited panel physician approved by the Department of Home Affairs. 
  • Obtain police clearance certificates from any country where you spent more than 12 months in the past 10 years. To avoid refusal, obtain them before lodging the visa application.

Eligibility Criteria for Employer-Sponsored Visa

  • You must be under 45 years of age when you apply for the visa. (Exemptions if: nominated academic, medical practitioner in a regional area, scientist/researcher, held specific visas, or met work criteria.) 
  • You must be nominated by an employer whose business is lawfully operating in Australia. 
  • You must prove you have the necessary skills and at least 3 years of full-time employment in the nominated occupation within the last 5 years. 
  • You must have your skills assessed as suitable for the nominated occupation by the relevant assessing authority. The assessment will show us you have the skills to work under work visa in the nominated occupation. (Exemption: Academic nomination or 3-year work on 444/461 visa.)  
  • You must have at least Competent English to be granted this visa.  
    (IELTS: At least 6 for each of the 4 components  
    TOEFL iBT: At least 12 for listening, 13 for reading, 21 for writing, and 18 for speaking 
    PTE Academic: At least 50 for each of the 4 components 
    OET: At least B for each of the 4 components  
    Cambridge C1 Advanced test: At least 169 in each of the 4 components (only results from the paper-based test accepted from 12 February 2024)) 
  • You and any family members who apply for the visa with you must meet health and characters requirements. 
  • You should not have had a visa cancelled or a previous application refused 
  • You or any family members should not owe any money to the Australian government or have paid back a debt.

Temporary Skill Shortage Visa
(Subclass 482)

The Temporary Skill Shortage Visa (Subclass 482) visa is a temporary work visa that allows Australian employers to sponsor overseas workers for positions they can't fill locally. There's also a Labour Agreement stream for special agreements. This visa can lead to permanent residency through the Short-Term and Medium-Term stream. Applicants need to be sponsored by an approved employer, have relevant skills and experience, meet English language requirements, and pass health and character checks.

(Subclass 186)

The Employer Nomination Scheme (Subclass 186) visa is a permanent residency visa that allows skilled workers nominated by an Australian employer to live and work in Australia permanently. This scheme aims to fill critical skill gaps within the Australian labour market. It enables nominating employers to secure talented individuals who can contribute to their business operations and support the Australian economy. The visa is available through three streams: the Direct Entry stream, the Temporary Resident Transition stream, and the Labour Agreement stream, each catering to different pathways for skilled migration.

Skilled Employer Sponsored Regional (Provisional) Visa (Subclass 494)

The Skilled Employer Sponsored Regional (Provisional) Visa (Subclass 494) visa allows regional employers to sponsor skilled workers to live and work in designated regional areas of Australia. This visa addresses labour shortages and provides a pathway to permanent residency after 3 years via Subclass 191. An approved employer must nominate visa applicants, have a relevant occupation, obtain a positive skills assessment, and meet experience, age, English, health, and character requirements. 

Employer Sponsorship Visa Processing Time

The processing times for various Employer Sponsored Visas vary based on the visa subclass and individual circumstances. For the TSS Visa (Subclass 482), document preparation typically takes 2 to 4 weeks, with post-lodgement processing lasting 2 to 6 weeks. If a Skills Assessment is necessary, expect an additional 2 to 3 months for processing, depending on the assessing authority. 

Document preparation also takes 2 to 4 weeks for the ENS Visa (Subclass 186).  However, post-lodgement processing for this visa can take 6 to 10 months, with an additional 2 to 3 months for Skills Assessments if required. The processing time for the Skilled Employer Sponsored Regional (Provisional) Visa (Subclass 494) can vary based on the complexity of the application and documentation provided. On average, around 11 to 12 weeks is required for a portion of applications to be processed, while more complex cases can take up to 6 months.
